OUR COMMITMENT

We commit to the idea that every person should be able to enjoy their experience on the water, without exception.  Our highly motivated company members strive to go above and beyond to make the experience fun, memorable, and above all safe.  It is our hope that we provide an experience that motivates you to become lifetime paddlers.

GENERAL CONDITIONS

These “Terms & Conditions” apply for any booking, that be a course, tour or rental.  This also includes all members’, member guests, and non-members.

Project E2, LLC strictly adheres to health & safety procedures; however, when dealing with nature there always exists an element of risk. Please be aware that both kayaking and hiking do carry a signficant degree of risk. Safety instructions will be given to you by a Project E2, LLC representative and must be adhered to at all times.  Project E2, LLC cannot explain and describe all potential and existing safety hazards; you must exercise sound judgement and seek additional information in order to keep youself safe.  When renting equipment, proper use of the equipment must be adhered to at all times.  Do not use equipment in a way it was not designed to be used or outside your ability.

We reserve the right to make changes and adjustments to these terms and conditions without prior notification to any client. We will do our utmost to fulfill the terms that you agreed upon when booking. Cancellation policy is not changeable (see cancellation section for further information).

PRIVACY POLICY

PHOTOGRAPHY, VIDEO, & NAMES

By agreeing to the Terms & Conditions, you give Project E2, LLC and its representatives permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of the Project E2, LLC activities to include but not limited to; kayaking, events, stand-up paddle boarding, tours, classes, guided trips, and all times on Project E2, LLC premises.  You agree that Project E2, LLC and it’s representatives have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose consistent with the Project E2, LLC missions.  These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet.  You acknowledge that you will not receive any compensation, etc for the use of such pictures, etc., and hereby release Project E2, LLC and it’s representatives, agents and assigns from any and all claims which arise out of or are in any way connected with such use.

You also give consent to the Project E2, LLC and its representatives to use your name and likeness to promote the Project E2, LLC program, its fiscal agent, and/or their activities.

Project E2, LLC does not intend to misuse any media or names collected, but also understand that there are circumstances where you may want to opt out.  Please speak directly with use if you wish to opt out BEFORE any images are taken.  For those opting out, an additional opt-out agreement must be signed.

RESERVATIONS

In order to provide for the best experience and to ensure the proper equipment and leader to client ratio, it is often necessary to make reservations.

Reservations can either be made directly on the website at www.kayakspokane.com or by telephoning directly.  Reservations for courses must be paid in full at time of booking.  For cancelation, see cancelation paragraph in the Terms & Conditions.

We accept all major credit cards for the initial deposit.  When we receive your trip application and deposit we will confirm your space; however, confirmation is not final until we also receive a copy of your completed trip application.

For multi-day and expeditions, the following deposit amounts are required to confirm your space(s) on your reservation:
Trips lasting 6 or more days:  25% per person.
Trips lasting 4 or 5 days:  20% per person.
Trips lasting 3 days:  15% per person.

Please note: international tours require a 50%, due 120 days prior to departure.

BALANCE DUE
USA-based trips:  Full payment is due 60 days prior to departure.
International trips:  Full payment is due 90 days prior to departure.

Reservations made after the balance due date must be paid in full at the time of booking. We reserve the right to cancel your reservation if full payment is not received by the due date.

Reservations for equipment and rentals must be paid in full at time of reservation.  No refund will be offered if cancelled within 24 hours of rental period.

PRICING

All tours, equipment, and rentals are priced in US dollars.  Any foreign currency pricing is only approximate. Project E2, LLC charges in US dollars and it is your credit card company or bank who determines your exchange rate on the day your transaction takes place. Pricing is subject to change.  Project E2, LLC is not responsible or liable for any differences based on exchange rates or fees charged by credit card and banking companies.

For all Washington State tours there is an additional approximately 9% tax called the GST (Goods and Services Tax).  This tax will be charged in accordance with current tax rates for Washington State.

CANCELLATIONS AND REFUNDS
If you find it necessary to cancel your trip, course, and/or rental, please notify Project E2, LLC immediately in writing, by e-mail or fax.  If written cancellation is received (call to verify if you do not receive a confirmation email) before the final balance is due, you will be given a refund less the amount of the deposit.  Deposits are not refundable outside of what is outlined below.  If cancellations are made on or after the final due date, no money will be refunded.  If you are unable to go on the trip, you are welcome to find a replacement for yourself; however, they must meet all the qualifications and requirements required for yourself to reserve the course, trip, and/or equipment.  Please understand that once you’ve signed up, we lose the right to sell your reserved space to other individuals or groups.  If you do have a personal emergency, we will do everything we can to assist in re-booking or finding a replacement.  Regrettably, if we cannot find a replacement, you will not be refunded outside the policies outlined in this agreement.

The following fees will apply to cancellations and are calculated as of the date we receive your written cancellation notice, which can be sent by email, fax or standard mail.

United States Tours/Course: If you must cancel your tour, your refund is as follows:

Earlier than 90 days before trip – If we have not had to turn customers away, full amount is refunded less a $100 administration fee. If we have had to turn customers away, the deposit is retained.

89-30 days before trip – 50% of total tour price is refunded.

Later than 30 days before trip – No refund will be given, unless we can find someone to fill your space. In this case, only the deposit is retained.

International Tours/Classes: If you must cancel your tour, your refund is as follows:

Earlier than 90 days before trip – deposit is refunded less a $250 administration fee and any other deposits required from Project E2, LLC to book accommodation, equipment, and/or services. The guest is responsible for any costs incurred for cancelling any additional tours or travel arrangements. If we have had to turn customers away, the entire deposit is retained.  If a replacement is found, only the $250 administration fee will be charged.

90-60 days before trip – 50% of total tour price is refunded.

Less than 60 days before trip – No refund will be given, unless we can find someone to fill your space. If we can fill your space, only the full deposit is retained.

Equipment rental and demo, your refund is as follows:

Less than 7 days prior, 100% refunded for members, 50% refund for non-members.

72 hours or less, there will be no refund unless a customer reserves the same equipment within that 24 hour or less period.  If it is not re-rented, there will be no refund.

TRAVEL PROTECTION PLAN
We strongly recommend that all guests purchase trip cancellation and interruption insurance (Travel Insurance).  This should include a full trip refund should you cancel at any time for medical or health reasons.  Trip insurance is mandatory for all international tours.  Project E2, LLC is not responsible for you ensuring the appropriate level or amount of coverage is purchased. Please contact your travel insurance provider to ensure you have appropriate coverage for your entire trip.

GROUP AND CUSTOME TRIP RATES

We generally offer a Group Rate for groups of 10 or more on most of our guided trips, rental equipment, and courses.  You always have the option of arranging for a private group course, tour, and equipment rental. Contact us for details.

PREPARING FOR YOUR TRIP
Once you’ve made your choice and sent in your deposit, we’ll send you a detailed document that includes everything that you will need to prepare for your tour including an itinerary, packing list, transportation options, directions, meeting times and frequently asked questions. For international tour destinations, we include information about issues such as passports, visas, immunizations and currency exchange.

Most of our trips are suitable for beginners; however, some are more active than others.  A spirit of flexibility and adventure is a good thing to bring along.   It’s important that you understand the physical requirements for whatever trip you choose.  If you’re not sure about this, or you’re not sure which trip or date will best meet your needs, please call us and we will help guide you through your decision.  Be sure to read this agreement in its entirety and ask any questions you may have.

Let us know if you’re planning a birthday or anniversary trip. If you have special dietary considerations, please let us know when booking and we’ll make all the accommodations necessary if you’re vegetarian, vegan or have food allergies. Please note we are not a peanut or nut free facility.

TRIP MEMBER’S RESPONSIBLITY
Trip members have the responsibility to select a trip appropriate to their abilities and interests. We are happy to discuss the trip with you if you have any questions or concerns. Trip members are held responsible for being in sufficient good health to undertake the trip. Members are also responsible for studying all pre-departure information; for bringing the appropriate clothing and equipment as detailed therein and, for acting in a manner considerate of fellow group members.

Any person who is diabetic, epileptic, or asthmatic or has a history of heart trouble, is allergic to bee/scorpion stings or takes daily prescription drugs should include this information on the reservation form or inform our office. Trip members will also alert their guide (s) of any medical history that could become a problem on the trip. People with a history of heart trouble, pregnant women or any other potentially serious medical condition should consult their doctor before coming on a trip. By agreeing to these terms and conditions, you acknowledge that it is your responsibility to ensure you are medically, physically, and psychologically capable of attending the tour, course, or to rent equipment.  You also acknowledge that we often operate in remote locations, which have significant delays in medical care, and assume the risks of operating in those remote locations.

A medical questionnaire must be completed and signed for any trip, course, or equipment rental longer than 2 days.  This questionnaire must not be older than 90 days at time of travel.  Project E2, LLC reserves the right to decline participation or rental based on the information provided.

Medical and Risk Acknowledgement

Each participant is required to fully fill out the medical form and liability release form. Project E2, LLC must receive forms within 10 days of the original booking.

You are responsible for your behavior.  Project E2, LLC reserves the right to decline to accept or restrain from further participation- any person whose actions or deportment impede trip operations or rights, welfare or enjoyment of other trip members.  A refund based on cost of unused land services is the limit of Project E2, LLC responsibility.

You must also acknowledge that travel with Project E2, LLC requires a degree of flexibility and understanding that the trip’s route, itinerary, accommodation and modes of transport are subject to change without prior notice due to local circumstances.

While traveling with Project E2, LLC you agree to accept the authority of the leader at all times. You need to be aware that group travel may involve compromise to accommodate the diverse desires and abilities of group members. We just ask that you welcome your adventure with an open mind and be able to laugh and have fun when encountering the unexpected. We are dedicated to providing safe, environmentally sensitive, well-organized, fun-filled adventure and ask that you help us share our enthusiasm with you.

IMPORTANT NOTICE
Payment of your deposit represents your acceptance of the following conditions: Project E2, LLC, its subsidiaries and cooperating agencies act only in the capacity of agents for the participants in all matters relating to transportation and/or all other related travel services, and assume no responsibility or liability whatsoever for injury, loss or damage to person or property, however caused, in connection with any service, including, but not limited to, that resulting directly or indirectly from acts of God, detention, irregularity, annoyance, delays and expenses arising from strikes, theft, quarantine, pilferage, force majeure, failure of any means of conveyance to arrive or depart as schedule, government restrictions or regulations, civil disturbances, and discrepancies or changes in transit over which we have no control.

Project E2, LLC reserves the right, either prior to or after departure, in its good-faith discretion and in circumstances that warrant it, to change or re-price any tour, trip, or expedition.  This includes the possibility of moving to a different river or river segment due to extreme water conditions, forest fires, road closures and/or acts of God.
If we are not able to provide a substitute trip, river, or altered itinerary and have to cancel the departure completely, you will be refunded in full. Refunds are limited to the amount actually paid to Project E2, LLC by the participant.

For non USA-based trips, Project E2, LLC must normally make substantial payments to its suppliers (hotels, transportation companies, etc.) far in advance of the trip departure date.  If Project E2, LLC cancels any tour, trip or expedition due to acts of insurrection, force majeure, strikes, popular demonstrations, acts of God, earthquake, flooding, or any cause beyond its control, Project E2, LLC will refund the portion of the trip cost not already advanced to suppliers and use its best efforts to recover and refund the balance as promptly as possible.

Project E2, LLC reserved the right to cancel trips that are below the trip minimum (usually 4-5 persons).  All trip members will be notified a minimum of 30 days before the trip departs and will receive a full refund.

In the event of trip cancellation, Project E2, LLC is not responsible for additional expenses incurred by trip members, such as penalties incurred through the purchase of non-refundable airline tickets, medical expenses and passport and visa fees.

FOREIGN TRAVEL
This can feel daunting and you probably have a lot of questions, so we are here to help.  Project E2, LLC operates all trips and courses.  We do however, occasionally use third parties to help with logistics and other necessities for some international trips.  As a result, Project E2, LLC. their employees, shareholders, subsidiaries, affiliates, officers, directors and successors, are NOT liable for any expense, irregularity, bodily injury or death to person, damage to property, negligent or willful act or failure to act of any such company or individual providing these services, or of any other third party.
Passports and Visas

You must carry a valid passport and/or necessary documentation and have obtained the appropriate visas when travelling with Project E2, LLC Please ensure your passport is valid for 6 months beyond the duration of your trip. It is your responsibility to ensure that you are in possession of the correct visas for your travels. Project E2, LLC does not accept responsibility if you are refused entry to a country because you lack the correct documentation or the authorities deem you unsuitable for entry.

International Tours: Hotel portions of tours are based on double occupancy. If you prefer a single room, there is an additional $100-night single supplement charge. Availability of single rooms may be limited. All tenting is also based on double occupancy, however if you are travelling alone we do our best to provide you with your own tent or a suitable tent partner.

TIPPING

Gratuities are always appreciated. If you feel the guides, coaches, and crew have done an exceptional job, tipping is a great way to show your appreciation. We also appreciate other expressions of thanks including cards, letters etc.

RENTAL SPECIFIC INFORMATION
For all kayak rentals the following statement must be agreed to:
“I hereby state that I take the full responsibility for my own safety during the rental period. I am aware that all paddle-sports (i.e. kayaking, rowing, canoeing, stand-up paddle boarding, etc.) have certain risks, and I will consider these risks when I am on the water. I will return the equipment in the same state as when I was given it. If the equipment is not returned within the rental period, or damaged in any way, Project E2, LLC is entitled to put down extra costs according to the delay or damage. I also agree to complete and sign all rental forms prior to renting any equipment.”

Anyone interested in renting from us or signing up for a tour, should know that we exercise safety precautions in all that we do.  First time renters may be asked to do any of the following; take a safety course (not diving, swimming, or any other water sport), perform a self-rescue, attend an instructional class on wet exit drills (practice release of spray skirts) and rescues, or rent and/or wear a wetsuit or another appropriate protective garment.

All renters will be encouraged to exercise sound judgment, seamanship and self-responsibility.
We reserve the right to refuse services or rentals to anyone who is: underage and unaccompanied, intoxicated or otherwise impaired, unruly or overtly irresponsible, show signs of obviously bad judgment, or signs of not being capable of safely operating the equipment.
